Haiti - Justice : The CSPJ reminds magistrates of the prohibition to participate to political activities

In a resolution dated February 10, 2026 (CSPJ-SP/02-2026/88), the Superior Council of the Judiciary (CSPJ) considers that any political involvement by magistrates is likely to compromise their impartiality and affect the credibility of the judicial institution. Consequently, it reminds magistrates that they are bound by a "strict obligation of discretion and political neutrality."

Text of the resolution :

"The Superior Council of the Judiciary;

Having regard to Article 184-2 of the Constitution of the Republic of Haiti;

Having regard to the law establishing the Superior Council of the Judiciary;

Having regard to the law governing the Statute of the Judiciary, particularly Article 5;

Having regard to the Code of Ethics for Magistrates;

Considering that independence and impartiality constitute the cardinal principles of the judicial function;

Considering that any political involvement of judges is likely to compromise their impartiality and affect the credibility of the judicial institution;

Considering the need to preserve the public's confidence in the judicial system;

Recalling that judges are bound by a strict obligation of discretion and political neutrality;

RESOLVES :

Article 1 : All judges, at all levels and ranks of jurisdiction, are reminded that they are required to refrain from any participation in political activities and to remain outside the political arena.

Article 2 : Judges must avoid any behavior, statement, or action likely to undermine their duty of impartiality or harm the image and dignity of the judicial institution.

Article 3 : Any failure to comply with the obligations set forth in Articles 1 and 2 of this resolution shall subject the perpetrator to disciplinary sanctions in accordance with applicable laws."
