Haiti - CEP : Failed mediation, «Religions pour la Paix» abandons

Began November 5, 2012 the process of mediation of "Religion of Peace" had allowed to lead to the signature,on 24 December 2012, of a agreement between the Executive and Parliament on the creation of a "College Transitional of Permanent Electoral Council" charged to realize the next elctions.

However, in Article 5 of the agreement, it was stated "The platform Religions for Peace Haiti will lead, with the assistance of the Executive and Legislative powers, the negotiations necessary to enable the Superior Council of the Judiciary (CSPJ) to solve the problemrelated to the appointment of its representatives in the electoral institution [CEP]."

In accordance with this article, after a meeting January 5, 2013, between the three powers in order to help solve the problem raised by its representation in the CEP, "Religion for Peace" sent an letter, to the 3 representatives of the CSPJ installed to the CEP [Patrick Métellus, Yves Benoit Jean-Marie et Salnave Exantus]

Euvronie Georges Auguste, representative of sector voodoo in "Religions for Peace" indicated that despite all efforts, due to the persistent refusal of the 3 representatives of the Superior Council of the Judiciary (CSPJ) to meet the members of the CSPJ and the unwillingness of judiciary concerning the withdrawal of its representatives installed to the CEP, following a disputed election. Accordingly, in a letter addressed to the Executive, "Religion for Peace" has officially announced that they were more involved in mediation and asked the three powers, to assume sole their responsibilities in the conflict between the CSPJ, to its first three representatives in the Electoral Council.

In summary, the situation is as follows :

The representatives of CSPJ installed in the CEP, maintain their position, namely that on a purely legal planafter being sworn before the Court of Cassation they are no longer subject to the CSPJ and are not responsible for the crisis..

For the CSPJ is to the Executive to solve this situation, since these 3 representatives have been appointed by a decree and it is up to the Executive to take another decree to allow the installation of 3 new representatives designated by the CSPJ.

The position of the Executive, within the constitutional framework, due to the independence of the 3 powers, remains unchanged, noting that it is the CSPJ that sent the names of these 3 representatives and that it is therefore to the CSPJ to convince them to leave. The executive stresses, that it is still possible to solicit his help, this is not its responsibility to intervene.

Today, the situation is deadlocked due to the independence of the CEP and of 3 Powers. The only way to out, continues to be the voluntary departure of 3 representatives installed for 10 years to the CEP, which does not seem, for the moment, on the agenda...
