Haiti - Politic : That the Parliamentarians give the example

The 1987 Constitution in its Article 238 stipulates that "officials indicated by law have the obligation to declare the status of their net worth to the Clerk of the Civil Court within thirty (30) days following their entry into service."

For its part, the Inter-American Convention against Corruption (ICAC), ratified by Haiti, provides in Article III a number of preventive measures, including "the creation, maintenance and strengthening of systems for reporting income, assets and debts by persons exercising public functions as specified by law."

This double vow Constitutional and Conventional was completed by the Haitian government with the passage of the law of 12 February 2008 on the declaration of asset by certain classes of politicians, civil servants and other public officials, law that the ULCC has the obligation to apply (Sections 4, 5, 6, 9, 13, 14 and 21). This Act also provides in Articles 8, 8.1 and 8.2 an exit declaration of the agents concerned.

Political personalities, civil servants and public officials required to declare the status of their net worth are specifically named in Article 7 of the Act for the following categories :

  • Members of the Executive, of the the legislative and the Judiciary.

  • Other political personalities, members of independent institutions and representatives of local authorities.

  • The officials and other servants of Public Administration.

22 members of the present Government have made ​​their declaration of assets over the period 2011-2012.

  • The current President, Michel Martelly made his declaration of entry.

  • The Prime Minister, who is also Minister of Foreign Affairs and Worship, made ​​his declaration of assets. However, an update will be made in his statement.

  • Of the 21 Ministers of the Government Lamothe, 20 made ​​their declaration of assets including 10 Ministers renewed and 10 new Ministers.

  • 13 other declarations of the Executive are expected (1 new Minister, 4 Secretaries of State renewed, 6 new Secretaries of State and 2 Secretary General to the rank of Minister).

The Parliamentarians, Senators and Deputies, quick to criticize the Executive on the declarations of assets, whose the absence is the subject of all suspicions, speculations and rumors [and disinformation], are rather in poor position to give lessons of transparency to the Executive.

Only one senator made his declaration of assets over the period May 2011 to June 2012. This brings to 11 [on 30], the total number of Senators that have completed that formality since 2009.

4 Deputies have made their declaration of assets over the period May 2011 to June 2012. This brings to 39 [of 99], the total number of deputies having complied with this obligation since 2009...
