Haiti - Case Clifford Brandt : The Court of Appeals ordered the release of 6 police officers...

Friday, following the procedure of Appeal of 6 police officers, charged by judge Pierre Domingo Gabrielle for kidnapping, illegal restraint against ransom and conspiracy as part of a network of kidnapping led by businessman Clifford Brandt, the Court of Appeal of Port-au-Prince issued an order for teh liberation of 6 police officers, accused of involvement in this case "if they are not retained for other reasons."

Me Carlos Hercules one of the defense lawyers, confirmed the decision of the court ordering the release of his clients, but indicated that the order of the Court of Appeal has not yet been carried out "the Minister justice required that this order be sent to the Public Prosecutor of the Court of First instance [...]" noting that the Government Commissioner could not execute the nonsuit.

An apprehension justified since Me Lucmane Dellile, the Chief for the prosecution indicated, following this release order, that he did not intend to sign this "exequatur", but that he would appeal to the Cassation against the decision of the Court of Appeal.

For his part, Jean Renel Sanon, the Minister of Justice, declined to comment on judicial decisions, stating "It is necessary to allow institutions the chance to play their role."
