Haiti - Politic : No extension of terms for outgoing senators

During the Conference of Presidents held yesterday Monday, 2 important decisions were taken. The first rejects the proposal of Simon Dieuseul Desras, President of the Assembly, who wanted to extend the mandate of the 10 senators whose term expires this Tuesday, May 8, 2012, until the next elections, and the second decision confirms the presentation of the new Cabinet and the Statement of General Policy by the Prime Minister ratified, Laurent Lamothe on Tuesday, May 8.

The proposal of extension of the mandates of 10 outgoing senators, was challenged by several senators including Moïse Jean-Charles who sees in the eparture of his colleagues "a blessing for the Assembly" reproaching to the latter their unwillingness to serve the population [?] they also accuse them of having "sold their souls to the Executive" in exchange of advantages and for their re-election... For the Senator Moïse with these departures, "the Senate will now be able to function as a body worthy of the name [!]"

Most of the 10 senators who will leave the Senate this Tuesday, May 8, 2012 [Youri Latortue (AAA- Artibonite) ; Edmonde Supplice Beauzile (Alternative - Centre) ; Michel Clérié (ALternative - Grande Anse) ; Nenel Cassy (INITE - Nippes) ; Kely Bastien (INITE - North) ; Jean Rodolph Joazile (Alternative - Northeast] ; Evallière Beauplan )Alternative - Northwest) ; Anacacis Jean Hector (PONT - West) ; Yvon Buissereth (INITE - Sud) and Joseph Lambert (INITE - Southeast)] declared themselves satisfied of their work. They recognize however that it is not over, and expressed their intentions to return to the Senate to the next election, some even show a certainty, saying that it was the wish of their constituents...

Concerning the presentation Tuesday of the General Policy Statement of the Prime Minister ratified, Dieuseul Simon Desras confirmed that the Secretary General of the Senate had received a copy of the statement of General Policy, but he denounced the non-compliance with the procedure "The text must be provided to each Senator, in sealed envelopes, 48 hours before the session of rataification of the program of the new Prime Minister" lamenting that the executive do not master neither the procedure nor the internal regulations of the Senate...

Maybe the President of the Senate, before making the lesson to the executive, should have begun by mastering the Constitution, including Article 111.8, before proposing a proposal of extension unconstitutional, of mandate of outgoing senators...

Article 111.8 :

In no case, the Chamber of Deputies or the Senate can be dissolved or adjourned, nor the mandate of their members be extended.

Even if it recognizes that it will depend Tuesday, of the presence of senators, the Minister Ralph Theano responsible for relations between Parliament and the executive, believes that the Prime Minister ratified will be able to present this Tuesday, his new cabinet and its policy general.
